Business Today: Company Fined Half a Billion VND for Land and Construction Violations
The provincial government of Bạc Liêu recently imposed an administrative fine of nearly 550 million VND on Thuận Phát Gành Hào Joint Stock Company, located in the Long Điền Tây commune, Đông Hải district of Bạc Liêu province. This penalty was levied due to multiple violations in the areas of investment, land, and construction.
Regarding the investment violations, the company had delayed the progress of several construction items, including the operational and dining service areas, as well as parking facilities. Furthermore, other project elements such as fences and internal roads were left incomplete, and the company failed to meet the required standards for some project components.
In terms of land violations, Thuận Phát Gành Hào Joint Stock Company entered into eight lease contracts. These contracts included one agreement with Vũ Võ Bạc Liêu Company for seafood processing and traditional fish sauce production on an area of 1,100 square meters. Additionally, seven cooperation investment contracts were signed with seven economic construction organizations to install solar energy panels on the roofs of concrete steel pole structures, covering over 38,700 square meters.
However, even though the construction permit granted by the Construction Department specified 13 construction items, the company only completed three of them, and even those were not in accordance with the permit.
As a result of these three violations, the company was fined approximately 550 million VND. It has already paid the fine. To rectify the situation, Thuận Phát Gành Hào Joint Stock Company is required to complete all project construction items and relocate solar energy facilities to the roofs of the project buildings, following the regulations outlined in Prime Ministerial Decision 13/2020/QĐ-TTg regarding the promotion of solar energy development in Vietnam.
Regarding the fish sauce production facility, the company will be included in the detailed planning and will be allowed to continue its operations. However, the incentives, exemptions, and reductions in land lease fees will be re-evaluated according to regulations.
The provincial government of Bạc Liêu has also instructed the Tax Department to determine the recovery of lease fees (if applicable) for the misused area of 39,821 square meters, which did not meet the objectives of the project and violated investment, land, and construction laws.
In a previous report by Tiền Phong, it was stated that the Chairman of the Provincial People’s Committee had issued an inspection decision to oversee the compliance with legal regulations in the investment, production, business, and land usage activities of Thuận Phát Gành Hào Joint Stock Company. The inspection team will conduct the audit from the land handover and lease date until December 31, 2022.
Thuận Phát Gành Hào Joint Stock Company is an enterprise granted approval by the provincial government of Bạc Liêu to invest in the construction of a new shipyard and provide ancillary services for the fishing industry. This project has been considered crucial for the province’s maritime economic development, supporting seafood exploitation and contributing to the local economy.
