Government recommends early implementation of Land Law from July 1, 2024
In a recent development, the Vietnamese Ministry of Construction has submitted a proposal to the government, urging the National Assembly to consider the early application of the Land Law starting from July 1, 2024. This recommendation is aimed at accelerating the implementation of the Land Law No. 31/2024/QH15, which was previously scheduled to take effect from January 1, 2025.
Directives from Prime Minister Pham Minh Chinh
To expedite the process of introducing the Land Law 2024 into the public domain, Prime Minister Pham Minh Chinh has issued instructions to the relevant ministries and agencies at the local level. The Minister of Natural Resources and Environment is expected to take the lead, collaborating with other ministries and agencies, in proposing several Decrees to the government. These decrees will cover various aspects of land administration, including regulations on land investigation, registration, certification of land use rights and ownership, land compensation, support, and resettlement, land pricing, coastal encroachment, and administrative penalties.
The Minister of Finance will also work closely with the relevant agencies to present two decrees on the establishment of land development funds and the collection of land use and rental fees. Additionally, a regulation pertaining to the collection, management, and use of land exploitation and utilization documents will be proposed.
Similarly, the Minister of Agriculture and Rural Development will submit a Decree governing paddy land cultivation, while the Minister of Labor, Invalids, and Social Affairs will present a Decision outlining mechanisms and policies for employment and vocational training for individuals affected by land acquisition. The Minister of Home Affairs will propose a regulation on the establishment and management of administrative boundaries and guidelines for resolving unresolved cases.
Lastly, the Chairmen of Provincial People’s Councils and Provincial People’s Committees are responsible for issuing legal documents that provide detailed regulations for the implementation of the Land Law 2024.
Urgency and Compliance with Timelines
Prime Minister Chinh has emphasized the urgency of these tasks and instructed the respective agencies to adhere to the assigned deadlines. According to Decision No. 222/QD-TTg dated March 5, 2024, which outlines the plan for the implementation of the Land Law 2024, the ministries and agencies are required to issue relevant documents by May 2024. Notably, the regulation regarding coastal encroachment has already been issued in March 2024 and will be effective from April 1.
“Before March 31, 2024, the Ministry of Natural Resources and Environment, in coordination with the Ministry of Justice and other relevant agencies, will submit to the government a draft proposal (accompanied by a draft resolution of the National Assembly) to present to the National Assembly for approval of the Land Law 2024, which will take effect from July 1, 2024,” the official document states.
This recommendation by the Ministry of Construction reflects the government’s commitment to streamline land administration and ensure the effective implementation of the Land Law. Once approved, the early application of the Land Law from July 1, 2024, will help to address various land-related issues and contribute to the overall development of the country’s legal framework.
