Hà Nội Considers Returning Service Land through Auctioning, Resettlement, and Encroachment

UBND TP Hà Nội has recently issued Document 699, which was sent to the Department of Natural Resources and Environment, district and municipal authorities, and relevant parties to expedite the process of allocating service land.

Specifically, in order to promptly complete the allocation of service land to households and individuals in the area, the People’s Committee of Hanoi has instructed the district and municipal authorities to develop detailed plans for the allocation of service land to households and individuals. These plans should be reported to the Standing Committees of the Party, People’s Council, and People’s Committee in order to provide guidance and ensure that the allocation is completed by September 30.

For localities that already have a service land fund, the allocation should be carried out immediately according to the regulations for completed infrastructure projects. Attention should be given to completing investment and infrastructure procedures for service land funds that have not yet been completed for land clearance, or where technical infrastructure has not been invested in order to allocate service land to households according to regulations.

Localities lacking a service land fund should review the remaining auctioned land, resettlement land, commercial land, land law violations, and small scattered plots within residential areas (in line with planning) to propose and allocate suitable service land positions. These proposals should be sent to the Department of Planning and Architecture to ensure consistency and report to the municipal People’s Committee for approval before proceeding with further investment, land, and construction procedures.

In addition, the Hanoi People’s Committee has requested relevant parties to enhance communication and mobilize residents (on a voluntary basis) to accept monetary compensation in exchange for service land allocated to households and individuals due to the shortage of service land in their localities. Districts and municipalities are required to balance and prioritize the allocation of funds to carry out land clearance and infrastructure construction to facilitate the allocation of service land.

According to the Department of Natural Resources and Environment, the total demand for service land to be allocated to households and individuals in Hanoi is 360.52 hectares, involving 55,580 households. To date, Hanoi has allocated service land to 36,557 households, covering an area of 248.33 hectares. There are still 19,023 households, covering an area of 112.19 hectares, predominantly in districts such as Thanh Trì, Hà Đông, Mê Linh, Thanh Oai, Quốc Oai, Hoài Đức, that have not yet received their allocated service land.
