Khánh Hòa Province Removes Restrictive Land Division Regulations

This decision, signed by the Vice Chairman of the People’s Committee of Khánh Hòa province, Tran Hòa Nam, aims to facilitate the transfer of land use purposes and make it more accessible for the local population.
Simplifying Land Division Conditions
Previously, the regulations stipulated specific minimum land area requirements for each land type. However, the new decision informs that land division applications for changing land use from agriculture to residential purposes no longer require a minimum land area. This change eliminates the need for extensive technical infrastructure when applying for land division.
Removal of Additional Restrictions
Moreover, the decision also eliminates the provision that authorized district-level People’s Committees to determine the basic infrastructure conditions required for approving land use change applications. This decision alleviates the burden on residents and reduces unnecessary bureaucratic hurdles in the process.
Simplified Division of Residential Land
The revised decision now includes a provision specifically addressing land division for residential properties with gardens and ponds. It states that when dividing a portion of land with residential purposes, the resulting plot must meet the minimum size requirements specified in the regulations. However, this provision does not apply to the division of garden or pond areas. Consequently, residents can now proceed with land division without needing to adhere to the minimum area requirements for agricultural land.
With these modifications, the government of Khánh Hòa province aims to promote a more efficient and accessible process for land division applications.
