New Regulations on Land Titles to be Introduced in 2024

The Vietnamese government is set to implement new regulations on land titles in 2024, according to Vũ Hồng Thanh, the Minister of Land.

Changes to the Land Law

Specifically, the Land Law of 2024 will consist of 97 detailed provisions assigned to the government and 9 provisions assigned to various ministries for guidance on implementation. To ensure the prompt implementation of the law, the detailed regulations must be in line with the effective enforcement of the law.

Key Topics to be Addressed

This year, several decrees will be issued to enforce the Land Law, covering the following topics: detailed implementation of certain provisions, basic land investigations, land use fees and rentals, land prices, regulations on rice cultivation, coastal planning, and administrative penalties for land-related violations.

Additionally, decrees guiding the registration and issuance of certificates for land use rights, ownership rights attached to land, land information systems, compensation, support, and resettlement when the state reclaims land, and regulations on land development funds will also be enacted this year.

Oversight and Enforcement

According to Vũ Hồng Thanh, the Economic Committee, the National Assembly’s Ethnic Council, and other relevant bodies will oversee the issuance of decrees and circulars to ensure that all documents under the Land Law provide detailed and consistent regulations in line with the policy objectives of the Law.

Furthermore, Lê Minh Ngân, the Deputy Minister of Natural Resources and Environment, revealed that the Land Law of 2024 will introduce groundbreaking provisions on land planning, land use plans, land reclamation, compensation, support, resettlement, land transfer, land leasing, land use conversion, land finances, land prices, land registration, land use rights transfer certificates, and ownership rights attached to land. The Ministry of Natural Resources and Environment will focus on implementing pilot programs related to this law.

Currently, the Ministry is actively working with relevant ministries and agencies to develop two pilot programs: one on commercial housing projects based on agreements for land use rights or existing land use rights for different land (within the jurisdiction of the National Assembly), and another on the improvement and restoration of deteriorated, depleted, and polluted water resources in the Nhuệ-Đáy river system.

Market Oversight and Social Housing Development

In addition, the Economic Committee Chairman revealed that the National Assembly will closely monitor the implementation of policies and laws related to the management of the real estate market and the development of social housing from 2015 to 2023. The oversight will focus on directing and organizing the implementation, management, and regulation of the real estate market, real estate supply, real estate transactions, the activities of real estate enterprises, urban planning, and land use for real estate projects.

These new regulations aim to streamline land management and ensure fair and transparent processes for land-related activities, ultimately contributing to the stable and sustainable development of the Vietnamese economy.
