Park City Project Under Inspection for Document Submission
Thanh tra TP Hà Nội, the inspection agency in the city, recently requested the Department of Construction and the Department of Finance to report and provide documents related to the implementation of the Park City project, which is being developed by Vietnam International Urban Development Corporation (VIDC).
The inspection is part of the ongoing process to redefine land prices for the project.
Document Request
Thành tra TP Hà Nội has requested the Department of Construction and the Department of Finance to submit reports and provide documents related to the Park City project. The agencies have been asked to comply with the Plan No. 5737/KH-TTTTP issued on November 14, 2023, by the Inspection Agency, which outlines the implementation of Plan No. 320/KH-UBND issued on October 5, 2023, by the Hanoi People’s Committee regarding the implementation of the Central Steering Committee’s conclusions on the detection, transfer, receipt, resolution of allegations, criminal reports, and recommendations for prosecution of cases involving signs of corruption, economic crimes, and negatives.
Importance of Compliance
The inspection focuses on reviewing compliance with regulations on the management and use of state-owned assets and land management at the Park City project, where VIDC is the developer.
Reminder for Document Submission
On January 9, 2024, the Inspection Agency issued Document No. 148/TTTP-P6 and requested the Department of Finance and the Department of Construction to submit written reports and provide project documents for Park City no later than January 16, 2024.
However, as of February 5, 2024, the Inspection Agency had not received the required reports and documents from the Department of Finance and the Department of Construction. Therefore, the Inspection Agency issued Document No. 594/TTTP-P6, urging the prompt submission of the requested reports and documents related to the project.
Project Details
The Park City project is located in the La Khe and Yen Nghia wards of Ha Dong district, Hanoi. Previously, this area was part of Yen Nghia commune and La Khe ward in Hanoi, which were under the administration of Ha Tinh province.
The project covers an area of approximately 77.4 hectares and is planned to accommodate around 23,000 residents.
It is worth noting that the 1:500 detailed planning for the Park City project does not allocate 20% of the land for social housing, as required by regulations.
The project is also currently undergoing a reassessment of financial obligations.
Previous Decisions
In 2015, the Hanoi People’s Committee issued Decision No. 6077/QD-UBND, approving the adjustment of the overall detailed planning for the Park City project. However, it is important to note that the 1:500 planning did not allocate a 20% land fund for the construction of social housing.
The Park City project’s financial obligations were determined based on three legal bases: Section B, Clause 1, Article 4 of Decree No. 84/2007/ND-CP dated May 25, 2007, Section B, Clause 1, Article 20 of Decree No. 45/2014/ND-CP dated May 15, 2014, and Clause 3, Article 108 of the Land Law 2013.
Therefore, the Department of Natural Resources and Environment proposed that the Hanoi People’s Committee allow for additional financial obligations (if any) resulting from the adjustment of the planning and to review and determine the land use fees at the time of actual land handover in December 2016, when the land clearance was completed and land was received according to regulations.
As of July 2008, the Provincial People’s Committee of Ha Tinh (former) issued Decision No. 2926/QD-UBND, approving the land use payments for the Park City project. However, it was not until December 2016 that the Department of Natural Resources and Environment of Hanoi handed over the project’s land boundary markers to VIDC.
According to the Department of Natural Resources and Environment, the determination of financial obligations in July 2008 while the project had not yet completed land clearance is not in line with regulations.
The Department of Natural Resources and Environment also cited three legal bases to determine the financial obligations for the Park City project: Section B, Clause 1, Article 4 of Decree No. 84/2007/ND-CP dated May 25, 2007, Section B, Clause 1, Article 20 of Decree No. 45/2014/ND-CP dated May 15, 2014, and Clause 3, Article 108 of the Land Law 2013.
