Resolving the Projects of Bach Dat An Company

The Chairman of the People’s Committee of Quang Nam Province has recently issued a conclusion regarding the projects of Bach Dat An Joint Stock Company in response to questions from citizens. These projects have encountered various obstacles, including adjustments to master plans and detailed plans, land clearance issues, and the impact of the Covid-19 pandemic.
In 2023, central agencies will conduct inspections of real estate projects in Quang Nam Province. During these inspections, issues and limitations will be identified, and recommendations will be made to address them effectively.
The projects of Bach Dat An Company, despite receiving attention and directives from the Provincial Party Committee, the Provincial People’s Committee, relevant departments, and local authorities, have not yet achieved the desired results.
The incomplete projects have led to frequent complaints from residents, affecting security, public order, the image, and the investment environment in Quang Nam.
However, the situation is complex due to the financial limitations of the investor, resulting in the early mobilization of funds from the public. The lack of cooperation and problem-solving between the investor and the distribution unit has further complicated the situation.
The enforcement of tax measures and court judgments, as well as the investigation and collection of information and evidence, have encountered several difficulties. The local civil enforcement agencies, the Provincial Tax Department, and the Provincial Police have had to consult with higher-level authorities according to specific regulations.
The compensation and land clearance work has not received unanimous support and assistance from all affected residents. The process of land clearance, mobilization, enforcement, and construction supervision requires meticulousness and time. Without completing the land clearance work, related procedures cannot be carried out.
Currently, the Provincial Party Committee and the People’s Committee have developed a plan to address the existing limitations based on the conclusions of the Central Inspection Committee. Once the plan is approved, the Province will focus on resolving the projects of Bach Dat An Company.
In the event that the investor is unable to continue with the projects, the Provincial People’s Committee will take decisive measures to resolve them in 2024.
Previously, Bach Dat An Company (the investor) and Hoang Nhat Nam Investment Joint Stock Company (the distribution unit) signed a contract regarding the distribution and development of projects in Dien Ban town, Quang Nam Province. However, disputes arose between the two parties, leading to legal proceedings, which affected the issuance of land use certificates for approximately 800 customers.
Despite the court’s verdict and numerous directives from the Provincial People’s Committee to resolve the existing issues and obstacles related to the projects of Bach Dat An Company, the company has failed to fulfill its obligations. Over the years, land buyers have continuously sought help from government authorities to protect their rights.
