The trial of Mr. Trần Quí Thanh (born in 1953; former Director of Tân Hiệp Phát Trading and Service Limited Company) and his two daughters, Trần Phương Uyên (born in 1981; former Deputy Director of Tân Hiệp Phát Trading and Service Limited Company) and Trần Ngọc Bích (born in 1984; former Director of Tân Hiệp Phát Trading and Service Limited Company), is set to be held on April 23, according to a source from Người Lao Động newspaper. The three individuals will face charges of “Abuse of trust to misappropriate property.”
Mr. Trần Quí Thanh and his daughter Trần Uyên Phương were temporarily detained on April 10, 2023, while his second daughter is currently abroad.
The trial is expected to last until April 25, with Judge Huỳnh Văn Trực presiding. The defendants will be represented by four defense lawyers.
The court will summon four victims and 35 individuals with relevant rights and obligations.
The victims include Ms. Đặng Thị Kim Oanh (born in 1970), Mr. Nguyễn Văn Chung (born in 1986), Mr. Lâm Sơn Hoàng (born in 1960), and Mr. Nguyễn Huy Đông (born in 1982; all residing in Ho Chi Minh City).
According to the indictment, Mr. Trần Quí Thanh took advantage of provisions on lending and transfer contracts in the Civil Code to lend money with interest rates exceeding the threshold of the crime of “High-interest lending in civil transactions” under Article 201 of the 2015 Criminal Code, but without making collateral loan contracts.
Mr. Trần Quí Thanh forced businesses and individuals borrowing money to transfer project and real estate contracts to his two daughters, Trần Uyên Phương and Trần Ngọc Bích, in accordance with the law, but at significantly lower values than the actual value of the assets.
Subsequently, this group quickly carried out the transfer of ownership to gain control and determine the property. When the asset owners fulfilled their obligations to repay the principal and interest according to the agreement, the group used fraudulent means or created reasons to deliberately avoid repayment, misappropriating the assets of the four individuals, totaling over 1,048 billion VND.
Specifically, the group misappropriated the Minh Thành project, valued at nearly 428 billion VND as of August 2020, and the Nhơn Thành project (both belonging to Ms. Đặng Thị Kim Oanh), valued at nearly 454 billion VND. Additionally, they misappropriated 29 plots of land belonging to Mr. Nguyễn Văn Chung, valued at nearly 49 billion VND as of March 2020; 4 plots of land belonging to Mr. Lâm Sơn Hoàng, valued at over 80 billion VND as of November 2020; and 2 plots of land belonging to Mr. Nguyễn Huy Đông, valued at nearly 39 billion VND as of September 2020.
