Xác định, quản lý chi phí chưa đủ căn cứ, rõ ràng

In the inspection report No. 07/KL-TTr dated January 29, 2024 on the compliance with regulations, policies, guidelines of relevant agencies, as well as the powers and responsibilities of related agencies, organizations, and individuals regarding urban planning and construction implementation in Soc Trang province, the Provincial Inspectorate identified several limitations.

The inspection team conducted audits on three plans developed by the Department of Construction, including zoning plans for the eastern direction of Soc Trang City, zoning plans for My Xuyen town at a scale of 1/2000, and the general planning for Vinh Chau town until 2035.

For the general planning of Vinh Chau town until 2035, the Vinh Chau town People’s Committee did not select a consulting organization to develop the urban planning according to the regulations in Article 1 of the Urban Planning Law 2009 and Article 12 of Decree No. 37/2010/NĐ-CP dated April 7, 2010, by the Government. The estimated costs were not based on clear principles and regulations.

According to the decision of the provincial People’s Committee in Official Letter No. 1269/CTUBND dated October 21, 2014, “The Vinh Chau town People’s Committee is responsible for organizing the development and approval of the general planning for the urban center of Vinh Chau town as stipulated by the Urban Planning Law 2009.”

The total budget (contained in the design task and planning estimates) of nearly 2.62 billion VND was determined and calculated based on the cost criteria for “general urban planning” as regulated in Circular No. 01/2013/TT-BXD, dated February 8, 2013, by the Ministry of Construction.

However, the Urban Planning Law 2009 only stipulates “general urban planning” and does not include the category of “general planning for the urban center.” General planning is developed for centrally-affiliated cities, provincial cities, towns, urban areas, and new urban areas. Furthermore, according to the regulations in point a, clause 2, Article 4 of Circular No. 01/2013/TT-BXD, which guides the determination of costs for urban planning projects, including the cost of preparing “general urban planning” content.

Therefore, it is concluded that the determination and management of costs for the “general planning for the urban center of Vinh Chau town” is based on the same criteria as “general urban planning” stipulated in Circular No. 01/2013/TT-BXD, which is not sufficient and does not have a clear basis according to the principles of cost determination and management, as stated in the inspection report.

Regarding the zoning plan for the eastern direction of Soc Trang City, the inspection team found that the task, options, and survey reports did not reflect supplementary survey and inappropriate evaluation of the actual situation at the time of the planning, concerning the topographic map before conducting supplementary surveys.

The topographic survey file lacked the required forms for requesting information, data, survey products, and maps. It also lacked confirmation of the origin of copies of information, data, survey products, and maps, as specified in clauses 1 and 3, Article 21 of Decree No. 27/2019/NĐ-CP dated March 13, 2019, by the Government, which provides detailed regulations on some articles of the Surveying and Mapping Law.

Furthermore, the organization of gathering opinions from agencies on the planning content did not fully comply with the regulations in clause 1, Article 21 of the Urban Planning Law 2009. The Department of Construction only held meetings with relevant departments and sectors to discuss and clarify the directions and routes of the Belt Road II in the area of Ward 4 and Ward 9, Soc Trang City.

With regard to the zoning plan for My Xuyen town at a scale of 1/2000, opinions were obtained through a survey. However, the record did not adequately demonstrate the collection of opinions from the community through a questionnaire. The storage of these opinions did not meet the prescribed requirements.

Based on the above information, the Soc Trang Provincial Inspectorate recommended the Department of Construction and the Vinh Chau town People’s Committee to correct and learn from these limitations. In the future, they should strictly comply with regulations for the development, evaluation, approval, and implementation of urban planning, as well as for the storage of community opinion questionnaires.

The Chief Inspector of Soc Trang province recommended that the Chairman of the Provincial People’s Committee issue an official request to seriously learn from the shortcomings for Mr. Duong Quoc Viet, former Director of the Department of Construction; Mr. Pham Anh Minh, former Deputy Director of the Department of Construction and current Secretary of the Chau Thanh District Party Committee; Mr. Nguyen Minh Hoang, Director of the Department of Construction; and Mr. Tran Hoang Thang, former Chairman of the Vinh Chau town People’s Committee.
