The local government of Thach That district has recently reported on the results of land management and construction regulations in the district, specifically addressing the unauthorized construction of the My House project in Tan Xa commune.

Taking action against unauthorized construction

According to the report, the district government has instructed the local authorities and the Urban Construction Order Management Team to inspect, supervise, and urge the demolition progress of the violated construction. The responsible authorities are required to regularly report on the progress and any difficulties encountered to ensure timely guidance.

The Tan Xa commune is responsible for developing a plan for enforcement and demolition in accordance with the regulations. If the investor fails to voluntarily dismantle the construction or fails to meet the demolition schedule, the authorities will enforce the dismantling of the violated structures.

The district government emphasizes the importance of adherence to land management and construction regulations, ensuring no new violations occur. To ensure effective management, a team of inspectors has been established to monitor the land management and construction activities of the Chairman, Vice Chairman, and specialized officials involved in Binh Yen and Tan Xa communes. This team is responsible for identifying and handling collective and individual violations. For the My House project, if the investor does not fulfill the voluntary commitment to dismantle the construction, enforcement measures will be taken, and the district police will initiate the necessary legal procedures.

Uncertainty surrounding the violated land area

A representative of the Thach That district government revealed that two administrative penalty decisions had been issued against the My House project for construction violations. The enforcement measures have led to the demolition of the 8th and 9th floors. The local authorities and relevant departments have continued to collaborate with the investor to ensure the progress of self-remediation and handling the violation.

Tan Xa commune has developed a plan, as outlined in Document 128 issued on November 2, 2023, to enforce remedial measures against construction violations in the commune.

Regarding the land violations, the district government has instructed Tan Xa commune to coordinate with various departments to verify the current status and land use origins. After an inspection, Tan Xa commune issued Document 206 on November 1, 2023, clarifying the management and land use by the investor.

However, the specific areas of the violated land, including residential and long-standing agricultural areas, have not been clearly determined. The lack of documents and records from state agencies complicates the establishment of administrative violation files. Therefore, the district government has sent a letter to the Department of Natural Resources and Environment and the Department of Justice of Hanoi City, requesting guidance to accurately determine the violated land area and proceed with the administrative violation files.

The local authorities and the Urban Construction Order Management Team will continue to monitor the progress of demolition, ensuring no construction activities take place and the violated area remains unused as intended.

Note: Previously, the “Tien Phong” newspaper reported on the unauthorized construction of the My House mini-apartment complex in Tan Xa commune, Thach That district. The project consisted of nine floors (six unauthorized floors) and nearly 200 apartments. In response, the Chairman of the Hanoi People’s Committee, Tran Sy Thanh, directed the Department of Construction, in collaboration with the Office of the People’s Committee and the Thach That district authorities, to investigate and clarify the information provided by “Tien Phong.” Additionally, they evaluated the responsibilities of relevant individuals and organizations based on Directive No. 24-CT/TU dated August 7, 2023, issued by the Standing Committee of Hanoi Party Committee, regarding the strengthening of discipline and responsibilities for work resolution within the city’s political system.
